On the evening of May 29, 2003, Deputy Sheriff Joshua Thomas Rutherford, 28, of the Blaine County Sheriff's Office in Montana, responded to a domestic disturbance along U.S. Route 2 near Harlem. Despite being off duty, Deputy Rutherford was called in to assist and arrived at the scene with another deputy. Upon encountering a suspect near a motel, the situation escalated when the suspect gained control of Deputy Rutherford's service weapon, fatally shooting him and wounding his partner.
