On an October evening in 2019, a gathering of friends at a home in Gary, Indiana, turned tragically fatal for 32-year-old Joseph Nieto. The man, a resident of the city, was hosting a get-together on October 23rd in the 2300 block of Edison Street where guests were drinking and listening to loud music. An argument erupted between Nieto and another man, escalating into a physical fight.
During the altercation, another individual, Enrique Gonzalez, 35, of Hammond, intervened.
Gonzalez pulled out a firearm and shot Nieto in the stomach. The single gunshot wound proved to be fatal for Nieto, who was a husband and a father to five children. The events of that night led to an investigation that would ultimately see his killer brought to justice, though not on the initial, more severe charges.
Enrique Gonzalez was later arrested and charged with murder, auto theft, and a firearms enhancement. However, in October 2021, he reached a plea agreement with prosecutors. Gonzalez pleaded guilty to the lesser charge of voluntary manslaughter. As part of the deal, he acknowledged that a self-defense claim would not have been reasonable, given the history of physical confrontations between Nieto and the other man involved in the initial fight. The murder and auto theft charges were dismissed, and a judge sentenced Gonzalez to 11 years in the Indiana Department of Correction.
