On a Saturday evening in Montgomery, Alabama, the life of 35-year-old James Charles Horn was tragically cut short. On November 12, 2016, Horn, a Black/African American male, was at his girlfriend's residence where about six other people were present when he was fatally shot. Remembered for his warm smile and welcoming nature, his sudden death left friends and family in shock and grief.
Funeral services were held for him on November 21, 2016, at the Narrow Lane Road Church of Christ, followed by his interment at the Alabama National Cemetery.
In the aftermath of the shooting, the Montgomery Police Department began an investigation that would lead to the identification of suspects. The U.S. Marshals Service Fugitive Task Force apprehended 48-year-old Kenneth Harvey Sr. in connection with Horn's death. He was subsequently handed over to the Montgomery Police and charged with one count of murder. The investigation continued, and in 2019, another man, Fredrick Whitaker, was also charged in relation to the murder.
The legal proceedings that followed painted a complex picture of the events that transpired on that fatal night. While Kenneth Harvey Sr. was arrested and charged shortly after the incident, the case against Fredrick Whitaker took a different turn. On December 12, 2022, a Montgomery County jury found Whitaker not guilty of the charges brought against him. His defense attorney argued that the acquittal was due to a lack of evidence and questioned the credibility of the state's witnesses, highlighting the challenges of securing a conviction in a case with multiple individuals present at the scene.
