In the early evening of September 8, 2026, a verbal altercation inside a home in the 5900 block of Jesse Owens Avenue in Birmingham, Alabama, turned deadly. Brian Montez Swain, a 54-year-old man from Birmingham, was shot and killed during the dispute. West Precinct officers responded to a call of a person shot at approximately 6:20 p.m. and found Swain unresponsive at the scene. Despite the efforts of Birmingham Fire and Rescue Service, he was pronounced dead at 6:43 p.m. from multiple gunshot injuries, including a wound to the head. The incident marked the city's 31st homicide of the year.

The investigation into Swain's death quickly led to a suspect. Following the shooting, the alleged gunman fled the scene. However, later that same day, the Violent Crimes Apprehension Team apprehended 51-year-old Derrick Gray in connection with the fatal shooting. The argument that preceded the gunfire was between Swain and Gray. It remains unclear if either the victim or the suspect resided at the house where the shooting took place.

Derrick Gray was arrested and is facing serious charges for his alleged role in Brian Montez Swain's death. He has been charged with capital murder and shooting into an occupied dwelling. Gray is currently being held without bond at the Jefferson County Jail as the investigation continues. The swift arrest brought a suspect into custody, but the legal process is just beginning. The case highlights the tragic and rapid escalation of a verbal dispute into a fatal act of gun violence, leaving one man dead and another facing the gravest of legal consequences. The matter is now set to proceed through the criminal justice system to determine the full scope of events that transpired on that September evening.
