In the late hours of a November night in Kansas City, Missouri, a young man's life was tragically cut short in a violent encounter. Dustin Niehouse, a 29-year-old male, was fatally shot on November 28, 2022. The incident took place at the Cloud9 liquor store, also known as Discount Smokes & Liquor, located at 4305 Antioch Road in the city's Northland.
Shortly after midnight, police officers responded to a call for an ambulance and discovered Niehouse at the scene, suffering from what was described as apparent trauma. Despite the life-saving measures initiated by the police and the arrival of emergency medical crews, he was pronounced dead at the location.
The investigation into the death of Dustin Niehouse soon focused on an employee of the liquor store. Mark Delano Shelton, a 56-year-old clerk, was identified as the individual responsible for the shooting. It was reported that Niehouse was shot five times. Following the shooting, Shelton did not call 911 but instead locked the store, turned off the lights, and contacted his manager. A person of interest was detained by police in the immediate aftermath of the incident. However, Shelton was not arrested until several months later. On June 6, 2023, a grand jury indicted him on charges of second-degree murder and armed criminal action, leading to his arrest on June 14, 2023.
As the legal proceedings unfolded, the case took a significant turn. Shelton was scheduled to face a jury trial, but an agreement was reached, and the charges were amended. He ultimately pleaded guilty to a lesser charge of first-degree involuntary manslaughter on March 3rd. Following his plea, the court recommended a sentence of 10 years in prison. In a separate legal action, Dustin Niehouse's mother, Valorie Niehouse, filed a wrongful death lawsuit against Groceries 4 Less LLC, the owner of the store. The lawsuit alleged negligence in the hiring, training, and supervision of Shelton. This civil case was resolved with a settlement, although the company did not admit liability.
