A birthday party on a Friday evening in Indianapolis turned tragic, ending the life of 27-year-old David Starks Jr. The fatal encounter took place on April 6, 2018, at the home of his stepfather, Leonard Booker. What began as a celebration for Booker's birthday descended into a heated argument and, ultimately, bloodshed.
Earlier in the evening, Booker had become intoxicated and was reportedly agitated, arguing with his wife, who was David Starks' mother.
Starks arrived at the residence amidst this turmoil. Witnesses reported that Starks attempted to de-escalate the situation, asking his stepfather to calm down and not disrespect his mother. The verbal dispute quickly escalated into a physical altercation between the two men. During the struggle, Leonard Booker, then 48 years old, produced a firearm and shot his stepson.
Indianapolis Metropolitan Police Department officers were dispatched to the residence in the 3100 block of N. Bancroft Street, near 32nd Street and Emerson Avenue, at approximately 9:15 p.m. upon receiving reports of the shooting. They found David Starks outside the home with a gunshot wound. Emergency medical personnel transported him to a nearby hospital, but he succumbed to his injuries shortly after arrival.
Leonard Booker was detained by police at the scene of the shooting. The following day, the IMPD confirmed that he had been arrested for the murder of his stepson. The investigation proceeded to the courts, and while initially charged with murder, the legal proceedings concluded with a different outcome. In September 2019, a jury found Leonard Booker guilty of a lesser charge, Level 2 felony voluntary manslaughter. Subsequently, in November 2019, a judge sentenced Booker to twenty-five years of incarceration, with five of those years suspended to probation. An appeal was later filed on Booker's behalf, arguing that a confession made to an officer at the scene was obtained illegally before he had been read his Miranda rights. However, the appellate court affirmed the conviction, noting that Booker had also confessed after being properly advised of his rights and that eyewitness testimony corroborated the events.
