In the spring of 2017, a confrontation at a Benton Charter Township intersection culminated in the tragic death of 37-year-old Nicholaus Kling, a White male from Benton Harbor, Michigan. On May 1st, Kling approached a vehicle stopped at the corner of Red Arrow Highway and Benton Center Road. Inside the car was his recent ex-girlfriend and her new partner, 22-year-old Derrick Bailey.
An altercation ensued, leading Bailey to fatally shoot Kling.
The events leading up to the fatal encounter began with Kling attempting to contact his ex-girlfriend earlier that day, seeking a conversation to find closure following their breakup. Despite her requests to be left alone, he persisted in sending messages. Later, he confronted the couple in their vehicle. According to court testimony, Kling was the aggressor, approaching the passenger side where Bailey was seated and beginning to punch him. In response, Bailey, who was armed, shot Kling three times in the face and chest. Kling succumbed to his injuries at the scene.
Following the shooting, Derrick Bailey was arrested and charged with open murder, carrying a concealed weapon, and a felony firearm charge. The open murder charge allowed the jury to consider both first and second-degree murder. During the trial, Bailey's defense argued that he acted in self-defense, portraying Kling as the instigator of the physical confrontation.
In October 2017, a Berrien County jury acquitted Derrick Bailey of the murder charge. However, he was found guilty of carrying a concealed weapon. For this conviction, Bailey faced a potential sentence of up to five years in prison.
