Stapleton also mentioned that he had bullets and was waiting for Banova, warning Ledwon not to lie to the police if questioned.
The confrontation turned violent when Banova was backing his white Dodge pickup truck out of his driveway. An argument ensued between Banova and Stapleton, who was outside his house along with his parents. According to police, Banova rolled back into his driveway, and Stapleton retrieved a long rifle from the passenger seat of his truck. He then approached Banova's driveway, raised the shotgun, and pointed it at Banova's truck. Surveillance video from Banova's home captured the incident, showing Stapleton firing four shots into the truck.
The defense argued that Banova had fired first from a handgun out of his driver's side window, prompting Stapleton to return fire. James Stapleton, 46 years old at the time of the incident, was arrested and charged with first-degree murder. He was held at the Clark County Detention Center.
