An evening of celebration took a tragic turn in the early morning hours of January 27, 2005, ending the life of 28-year-old Nicole DuFresne, a promising white actress and playwright. DuFresne, her fiancé, and another couple were walking on Clinton Street on Manhattan's Lower East Side after she had finished a shift at a new bartending job. Their cheerful mood was shattered when a group of seven young people confronted them with the intent to rob them.
The encounter quickly escalated
when one of the assailants, Rudy Fleming, demanded their belongings and pistol-whipped DuFresne's fiancé. In a moment of defiance, DuFresne confronted Fleming, reportedly asking, 'What are you going to do, shoot us?' This question was met with a fatal gunshot to the chest from Fleming. She died in her fiancé's arms at the scene. The group of attackers had already committed another robbery earlier that night and were, according to one of the perpetrators, angered by the sight of DuFresne and her friends being 'so extremely happy.'
The investigation into the murder led to the arrest of Rudy Fleming, who was 19 at the time of the incident. On October 12, 2006, a jury found Fleming guilty of first-degree murder, robbery, and weapons possession. He was subsequently sentenced to life in prison without the possibility of parole. Fleming, who was on parole at the time of the murder, later appealed his conviction, claiming mental instability, but the conviction was upheld.
Several of Fleming's accomplices also faced legal consequences. His girlfriend, Ashley Evans, who was said to have instigated the confrontation because the group's happiness annoyed her, pleaded guilty to first-degree robbery and received a six-year prison sentence. Another accomplice, Servisio Simmons, also pleaded guilty to first-degree robbery and was sentenced to ten years in prison. Other younger members of the group faced charges in Family Court.
