In the summer of 2015, the life of 19-year-old Ahziarh Carter was cut short by gunfire in Troy, New York. On the night of August 18th, Carter was near the intersection of Earl Street and Hutton Street when he was fatally shot. Another individual, Kadeion Mays, was also wounded in the incident. The shooting prompted an immediate police response, leading to a high-speed chase of a black Chevy Malibu. The chase ended near the Northway and Route 7 in Colonie, where police apprehended three individuals: 23-year-old Malcolm Reid, 21-year-old Stephon Johnson, and 16-year-old D'Andre Jones. A fourth individual, a minor, was also taken into custody. Inside the vehicle, authorities discovered several firearms. Initially, Reid, Johnson, and Jones were charged with felony weapons possession.
For several years, the homicide investigation faced significant hurdles, reportedly due to a lack of witness cooperation. However, in 2019, under a new district attorney's administration, the case was revisited. This led to a break in the case, and D'Andre Jones, then 19, was indicted on charges of second-degree murder and first-degree manslaughter for the death of Ahziarh Carter. The indictment came just as Jones was about to be released from prison on parole for the initial weapons charge. Prosecutors alleged that Jones was the individual who exited the Chevy Malibu and fired the shots that killed Carter and injured Mays.
In October 2021, a Rensselaer County jury found D'Andre Jones guilty of first-degree manslaughter. The conviction was secured based on forensic and circumstantial evidence presented by the prosecution. Following the verdict, Jones was sentenced to 20 years in prison. This outcome seemed to bring a measure of resolution to a case that had remained unresolved for over six years.
The legal saga, however, did not conclude with the conviction. In a significant turn of events, the Appellate Division of the New York State Supreme Court's Third Department reversed Jones's manslaughter conviction in November 2023. The appellate justices unanimously overturned the verdict, raising questions about the evidence that had been presented at trial. This decision left the pursuit of justice for the death of Ahziarh Carter once again without a definitive conclusion.
