Town Marshal Albert Byers, a 40-year-old male, was serving the community of Diamond, Indiana, during a period of heightened tension over local vice enforcement. In the weeks leading up to his death, Marshal Byers had taken a firm stance against illegal gambling operations in the area, issuing sweeping orders to shut down gambling rooms and confiscate slot machines.
These actions had drawn the ire of local business owners, including a 28-year-old saloonkeeper whose establishment had been targeted by the marshal’s crackdown. The saloonkeeper had reportedly made several threats against Byers in response to the enforcement measures, creating a volatile atmosphere in the small mining town in Parke County.
On the evening of April 9, 1905, around 7:00 p.m., the conflict came to a head near a local livery barn. The incident began when a former town marshal started assaulting another man, prompting the saloonkeeper to intervene in the dispute. As the group moved north toward McGregor's Saloon, Marshal Byers followed and confronted the saloonkeeper. The interaction quickly escalated from a conversation into a heated argument. During the altercation, Marshal Byers struck the saloonkeeper on the head with his mace. In retaliation, the saloonkeeper drew a revolver and fired a single shot, striking Byers above the right temple and killing him almost instantly.
Following the shooting, the suspect fled the scene but later surrendered to the Parke County Sheriff, claiming he had acted in self-defense after being struck. The death of the marshal left a significant void in his family; he was survived by his wife, five small children his parents, five brothers, and two sisters. A jury later accepted the defense's argument at trial, and the saloonkeeper was acquitted of first-degree murder. Marshal Byers was laid to rest in Clear Run Cemetery in Bridgeton, Indiana.
