In the autumn of 2019, the life of 34-year-old Heather Emelio was tragically cut short in her Warsaw, Indiana, residence. On the afternoon of October 15th, police responded to a distressing call about a woman with a gunshot wound at a home on Anchorage Road. Upon their arrival, they discovered Heather Emelio, who had sustained a fatal gunshot wound to her neck.
When officers first arrived at the mobile home, they were met by a frantic Kyle David Shaw, then 35 years old, who ran out of
the residence with blood on his hands, feet, and clothing. Inside, the grim discovery of Ms. Emelio's body was made, and she was pronounced dead at the scene. Investigators recovered the. 40-caliber handgun that was used in the incident. Shaw was taken into custody and subsequently charged with reckless homicide.
According to court documents, Shaw provided an account of the events that led to the fatal shooting. He claimed that he and Heather were in their bedroom, walking towards the bathroom, while he was holding the loaded handgun. He stated that Heather bumped into him, causing him to drop the weapon. In his attempt to catch the falling gun, he asserted that his thumb accidentally struck the trigger, causing it to discharge.
In March of the following year, Kyle Shaw pleaded guilty to the charge of reckless homicide. As part of a plea agreement, a charge of criminal recklessness while armed with a deadly weapon was dropped. During the sentencing, Heather's family expressed their profound grief. Her mother spoke of the deep loss she felt, and a letter from her grandmother conveyed the sorrow of no longer being able to see or hear from her. Ultimately, Kyle Shaw was sentenced to five years in the Indiana Department of Corrections. The judge ordered him to serve three years of that sentence in prison, with the remaining two years to be completed on probation. In addition to his prison sentence, Shaw was ordered to pay restitution to Heather Emelio's mother.
