In the early morning hours of June 16, 2024, a dispute between siblings in a Norfolk, Virginia, parking lot culminated in the shooting death of 24-year-old Kimaun T. Ewell. The male victim, from Richmond, was with his sister and three other people, having spent a night out in the Norfolk area.
Just after 5:00 a.m., while in the parking lot of a McDonald's on Shore Drive, an argument broke out between Kimaun and his 32-year-old sister, Kiana T. Ewell.
The disagreement reportedly began as the group was deciding whether to go their separate ways or head back to Richmond. After the argument started, everyone except Kiana got out of the vehicle she was driving. She drove off but returned moments later. Kimaun then approached the driver's side of the car and began to assault his sister while she was still seated inside.
During the physical altercation, a handgun Kiana Ewell had in her purse discharged, striking her brother once in the abdomen. Immediately after the shooting, Kiana got out of the car and attempted to render aid to her brother by performing CPR. Emergency services were called, and Kimaun Ewell was transported to a local hospital, where he succumbed to his injuries.
Norfolk Police detectives investigated the shooting and arrested Kiana T. Ewell, who was also a resident of Richmond. She was initially charged with second-degree murder and use of a firearm and was held in the Norfolk City Jail without bond. However, prosecutors later determined that there was no evidence of malice, and that the shooting appeared to be accidental, leading them to amend the charges.
Kiana Ewell ultimately pleaded guilty to involuntary manslaughter. She was sentenced to five years in prison, with all of the time suspended except for the four months she had already served in jail following her arrest. The family of both the victim and the accused expressed their desire for her to not serve additional time in custody, a factor that the prosecutor's office took into consideration when offering the plea agreement.
