On January 7, 2019, at approximately 5:53 a.m., 23-year-old Gary Herrera, a member of the deaf community and father to a three-year-old son, stepped outside his apartment complex near 59th Avenue and Indian School Road in Phoenix for a cigarette break. During this time, a red four-door sedan, occupied by two African American men, approached and backed into a parking space.
