In the fading light of a Thursday evening in Dothan, Alabama, the life of 47-year-old Michael Freigang came to an abrupt and violent end. On February 17, 2022, Freigang, a male resident of the city, was fatally shot by a Dothan police officer near the intersection of Montgomery Highway and Ross Clark Circle. The events that led to this tragic outcome began as a separate incident, a police chase that had concluded with the arrest of three teenagers in a stolen vehicle.
The area was an active crime scene, cordoned off by law enforcement. It was into this tense and fluid situation that Michael Freigang drove his pickup truck.
According to witness accounts, including that of a news reporter who was on the scene, Freigang's truck was seen waiting behind a line of police cars for a short period before attempting to navigate around the blockade. Officers who were present at the scene reportedly shouted at him to stop his vehicle. The Dothan Police Department later stated that Freigang had struck one of their vehicles and was driving towards other officers when one of them discharged their firearm, firing three shots. The truck continued to move, sideswiping the stolen vehicle from the initial chase before coming to a stop in a nearby ditch. Freigang was transported to a local hospital where he was pronounced dead.
In the aftermath of the shooting, the Alabama Law Enforcement Agency took control of the investigation, a standard protocol for officer-involved shootings in the state. As the investigation proceeded, Michael Freigang's family voiced their profound grief and confusion. His sister, Stacy Benefield, described her brother as having poor night vision and suggested he was likely confused by the chaotic scene. She and other family members contended that the use of deadly force was an unnecessary escalation, believing he was simply in the wrong place at the wrong time. The family also expressed their distress at having learned of his death through news reports, rather than from direct notification by law enforcement officials.
The investigation into the shooting continued for several months. In October of 2022, the findings of the State Bureau of Investigation were presented to a Houston County grand jury. After reviewing the evidence and testimony, the grand jury concluded that the Dothan police officer's actions were justified under the circumstances. They determined that there was insufficient evidence to proceed with criminal charges against the officer, and therefore, no indictment was issued. The case was officially closed, and the officer involved was cleared of any wrongdoing in the death of Michael Freigang.
