In a tragic act of domestic violence, 37-year-old April Marie Britton, a Black female, was fatally shot in Birmingham, Alabama, on October 23, 2023. The incident unfolded around noon in the backyard of a residence on Huffman Road. Britton was a loving mother to three children, aged 20, 17, and 13, and was known for homeschooling her two younger children. Her life was cut short in the very place she dedicated to her family.
Authorities identified her boyfriend, 48-year-old Emell O.
Peavy, as the alleged shooter. The shooting occurred in the presence of Britton's children, who then fled the scene to seek help. In a harrowing turn of events, they managed to flag down a passing vehicle for assistance. As they awaited the arrival of law enforcement, Peavy returned to the residence.
A good Samaritan who had stopped to help the children held Peavy at gunpoint until deputies from the Jefferson County Sheriff's Office arrived and took him into custody. Peavy was subsequently arrested and charged with capital murder, a charge elevated due to the crime being committed in the presence of a child under the age of 14. Investigators have stated the murder was domestic-related. Peavy has a prior criminal history, having previously served 16 years in prison for a 1991 beating death. He has since been indicted by a Jefferson County grand jury on the capital murder charge and is being held without bond.
