On December 8, 2022, at approximately 8:30 p.m., the Birmingham Police Department responded to a ShotSpotter alert and multiple 911 calls reporting gunfire in the 8300 block of 1st Avenue North. Upon arrival, officers discovered two men with gunshot wounds at a Shell gas station. One victim, 38-year-old Tobias Estrada McKinstry of Center Point, was pronounced dead at the scene by Birmingham Fire and Rescue.
