The victim was 44-year-old Joseph Iavarone, a man remembered for his happy-go-lucky nature and infectious smile. A longtime physical education teacher and coach in the Garnet Valley School District, he had recently retired after nearly two decades of service.
The fatal encounter unfolded on
the 100 block of Bishops Drive in the pre-dawn hours of Sunday, May 26, 2019. An argument erupted between Iavarone and his neighbor, 49-year-old John Ballas. The situation escalated, and Ballas retrieved a. 38-caliber revolver. Despite Iavarone's pleas of 'Don't shoot me,' a single gunshot rang out, striking him in the head. When law enforcement arrived, they found Iavarone unresponsive on Ballas's lawn. He was rushed to Crozer-Chester Medical Center where he was initially listed in critical condition before succumbing to his injuries on Monday night.
John Ballas was arrested at the scene and initially charged with attempted murder and aggravated assault. Following Iavarone's death, the charges were upgraded to criminal homicide, including first- and third-degree murder. The case proceeded through the legal system, and in March 2020, Ballas pleaded guilty to a lesser charge of involuntary manslaughter. This plea deal angered Iavarone's family and friends, who felt the charge did not reflect the gravity of the crime. Prosecutors defended the decision, stating it would have been difficult to disprove a self-defense claim at trial, given evidence that Iavarone had been intoxicated and acting aggressively. In August 2020, Ballas was sentenced to 23 months of supervised release, having already served nine months in jail.
