Benjamin McKinley Cunningham, a 56-year-old African American man from Clinton, NC, was tragically shot and killed on the evening of September 16, 2015, outside his home on West Morisey Boulevard. Cunningham was well-known in his community for his faith, culinary skills, and dedication to his family. He was a beloved father, husband, and active member of Saint Paul Church of Christ.
The investigation into Cunningham's death revealed that Scileek Phuqwan Washington, a 19-year-old at the
time, was the shooter. Washington, along with three other individuals, went to Cunningham's home that evening. During an altercation, Washington pulled out a gun and shot Cunningham in the chest before fleeing the scene in a car. Cunningham's son, Michael, witnessed the shooting and called 911, but despite efforts to revive him, Cunningham was pronounced dead at the scene.
Washington was arrested nearly two weeks later and charged with murder and possession of a firearm by a convicted felon. The case went to trial in 2019 but ended in a mistrial due to the jury's inability to reach a unanimous verdict. The case was retried in 2023, and Washington was found guilty of second-degree murder and sentenced to a minimum of 21 years and a maximum of over 26 years in prison.
The resolution of the case brought some closure to Cunningham's family and the community, who had been deeply affected by his loss. District Attorney Ernie Lee expressed hope that the verdict would provide a sense of justice and peace for Cunningham's loved ones.
