Gregory Howard Town, a 59-year-old neighbor, was arrested and charged with first-degree murder following the shooting. Town and Schneider were neighbors, and the altercation began over cars parked in front of Town's residence.

However, Superior Court Judge Nathaniel Poovey ruled that it was up to a Gaston County jury to decide if the killing was justified. Town's attorney argued that Schneider was the aggressor and that Town believed Schneider was trespassing on his property. Witnesses, including a medical examiner and a South Carolina woman who was present at the scene, provided testimony during a pre-trial hearing.
