Born on January 3, 1983, in Davidson County, he was the son of Patty Tart Gallion and the late Jimmy Overby. Marshall was survived by his wife, Megan Cox Overby, and their children, Avery, Jaden, and Mason. He also had several siblings, including James Overby, David Overby, Cecil Overby, Shelby Hopkins, and Nickie Hudson.
Marshall Overby's death was the result of a confrontation with a
bail bondsman in Archdale, North Carolina. The bondsman was pursuing Marshall because he had missed a court appearance. The pursuit led to a fight in the backyard of a home on Stratford Road. During the altercation, the bondsman fired a single shot at Marshall, hitting him in the torso. Despite efforts to save him, Marshall succumbed to his injuries and died at a nearby hospital.
The bondsman claimed that Marshall had attempted to stab him with a knife, prompting the use of lethal force.
