Nicklaus Jamaul Wilson, a 32-year-old Black man from Augusta, was killed in the early-morning hours of March 22, 2021, after gunfire erupted outside the Waffle House on Gordon Highway. Reports from the time said the shooting happened just before 2 a.m., and Wilson was found wounded in the parking lot and taken to Augusta University Medical Center, where the Richmond County coroner said he was pronounced dead around 2:30 a.m.
The killing left behind the kind of confusion that often hangs over late-night violence: a crowded restaurant, a brief encounter, and only fragments at first about why a life had ended in a place meant for coffee, food, and the slow winding down of the night.
As investigators pieced together what happened, authorities identified Andrew Deon Gaines as the suspect. Early coverage said Gaines was wanted soon after the shooting, and later reports said he was arrested in Columbia, South Carolina. According to testimony later described in local reporting, investigators said the two men did not know each other. Sgt. Chris Langford testified at a preliminary hearing that Gaines had arrived with two friends and was sitting in the backseat of a vehicle when Wilson approached the window as if greeting him. Langford said Gaines responded that he did not know Wilson, and investigators alleged that Wilson then made a motion suggesting he was revealing a gun before walking away. Langford testified that Gaines then pulled a gun and fired several times. Six 9mm shell casings were reportedly found at the scene, and investigators also alleged that Gaines left with a gun taken from Wilson and that a 2018 Kia Sportage was taken that same night.
The arrest led to a serious stack of charges. Coverage after Gaines was taken into custody said he was booked on murder, possession of a firearm during the commission of a crime, and theft, while later reporting on the prosecution said the case ultimately included malice murder, felony murder, theft by taking, and possession of a firearm during the commission of a crime. For a time, the case looked like it would move forward as a straightforward homicide prosecution, with Gaines held in Richmond County jail and the shooting framed by investigators as a killing outside a busy Augusta restaurant.
But the story did not end with the arrest. In March 2024, nearly three years after Wilson’s death, a Richmond County jury found Gaines not guilty. Reporting on the verdict said jurors accepted his claim that he acted in self-defense, clearing him on all counts. After years in jail awaiting trial, Gaines was released, and the case shifted from one that began with a wanted suspect and murder allegations to one that closed with an acquittal. That outcome left the death of Nicklaus Jamaul Wilson as both a killing and a courtroom battle over what happened in those moments outside the Waffle House, with the final legal answer coming not in an arrest warrant, but in a jury’s decision that the state had not proved murder beyond a reasonable doubt.
