investigation into Nicholas Welsher's death led the Rochester Police Department to two suspects: Luis Nieves and Brandon Thornton. It was revealed that Nieves was the architect of the crime, a drug-related robbery targeting Welsher. Nieves not only planned the robbery but also equipped his accomplice, Thornton, with the weapon that would be used to end Welsher's life. On that fateful day, Nieves drove Thornton to the vicinity of Lyceum Street, setting the stage for the deadly encounter. When Thornton confronted Welsher and attempted to rob him, the young man tried to flee for his life. In a heartless act, Thornton fired the gun, striking Nicholas in the back of the head and leaving him to die.
Following a thorough investigation by law enforcement, both Luis Nieves and Brandon Thornton were apprehended in October 2016, and the legal process to hold them accountable for their actions began. Brandon Thornton, the man who pulled the trigger, chose to plead guilty to Murder in the Second Degree on August 14, 2017. As a result of his plea, he was sentenced to 18 years to life in the New York State Department of Corrections.

On August 24, 2017, he was convicted of Murder in the Second Degree, Robbery in the First Degree, two counts of Criminal Possession of a Weapon in the Second Degree, and Conspiracy in the Fourth Degree. The conviction underscored his integral role in the events that led to Nicholas Welsher's untimely death. Following his conviction, Nieves was scheduled to be sentenced on September 29, 2017, facing a lengthy prison term for his part in the cold and calculated crime that ended a young man's life.
