On the night of July 18, 2015, authorities in Kansas City, Missouri, were called to a violent scene in the southern part of the city. Shortly before midnight, police officers arrived at a parking lot near a convenience store in the 7100 block of Longview Road, situated adjacent to The Bay Water Park. upon arrival, they discovered an unresponsive female victim suffering from a gunshot wound. The woman, identified as 31-year-old Misty Marion, had sustained a fatal injury to her back.
Despite the emergency response, she succumbed to her injuries and was pronounced dead at a local hospital, marking a tragic end to the weekend evening.
Investigators quickly pieced together the events leading up to the homicide through witness accounts. Marion had been in the parking lot of the water park with another individual when they were approached by a man. The encounter turned hostile, prompting Marion and the witness to flee the area on foot. As they ran from the confrontation, gunshots rang out, one of which struck Marion in the back. The proximity of the shooting to the water park was noted by police, who observed that the facility was closed at the time of the incident, a commonality with other recent acts of violence in the area that year.
Police focused their attention on a suspect identified by a witness as the man who had confronted them. Prosecutors subsequently charged 20-year-old Charles L. Austin with second-degree murder and armed criminal action in connection with Marion's death. Detectives uncovered a history of conflict between the two; court records indicated that Austin had been involved in an altercation with Marion earlier in the year, during which she allegedly stabbed him in the neck. Following his arrest, Austin admitted to being in the area when the shooting occurred but denied pulling the trigger, though reports surfaced alleging he had made disparaging remarks suggesting the victim 'deserved to die' due to their previous dispute. He was held on a $250,000 bond as the legal proceedings commenced.
