In the early morning hours of January 19, 2014, a dispute that began inside a Fort Wayne, Indiana, bar tragically ended with the shooting death of 32-year-old Damian J. Miller II. The white male was pronounced dead at the scene outside the Dupont Bar & Grill on North Clinton Street from an apparent gunshot wound. This incident marked the first homicide in Fort Wayne and Allen County for that year.
Accounts from witnesses indicated that Miller had been involved in an altercation with
another man inside the establishment. The argument escalated and moved outside, culminating in the fatal shooting. The Allen County Sheriff's Department launched an investigation into the circumstances surrounding Miller's death, piecing together the events that led to the deadly confrontation.
Following a thorough review of the investigation, the Allen County Prosecuting Attorney's Office announced that no criminal charges would be filed in connection with Damian Miller's death. The prosecutor, Karen Richards, stated that the evidence showed Miller had attacked the bar's security officer. According to the investigation, Miller struck the security officer in the head with a glass beer bottle, which shattered and caused injury. The security officer then shot Miller.
Prosecutors concluded that the security officer acted in self-defense. Under Indiana state law, a person is justified in using deadly force if they reasonably believe that the force is necessary to prevent serious bodily injury to themselves. Consequently, no arrests were made, and the case was closed without any charges, trial, or conviction. At the time of his death, Damian Miller was a field manager for Empire Industrial Equipment and was survived by his parents, a sister, and a brother.
