That evening, a man named Ronald Edward Gay entered the bar, ordered a beer, and then opened fire on the patrons, killing Overstreet and wounding six other people.

investigation that followed revealed a chilling motive behind the attack. Gay had reportedly expressed his intention to harm gay people earlier that day. He specifically asked for directions to a gay bar and, upon arriving at the Backstreet Café, carried out his deadly plan. The shooting was swiftly investigated as a hate crime, sending shockwaves through the Roanoke community and sparking a national conversation about the need for stronger hate crime legislation. Ronald Edward Gay, a 53-year-old Marine Corps Vietnam veteran, was arrested shortly after the shooting. Police found the 9mm pistol believed to have been used in the attack in a nearby trash can. Gay was charged with first-degree murder, along with multiple counts of aggravated malicious wounding and firearms charges. He ultimately pleaded guilty to the charges against him.

His defense team argued that he suffered from post-traumatic stress disorder and schizophrenia stemming from his military service.
