In the early morning hours of August 22, 2015, a fatal encounter unfolded in Irvington, New Jersey, that ended the life of 27-year-old Johnathan Vargas-Matilde. The incident took place at approximately 3:07 a.m. outside the Santa Fe Pizzeria and Deli located at 1428 Springfield Avenue. Vargas-Matilde, a Mexican immigrant, was with another individual when they were confronted by three men.
The assailants, who had been circling the area in a car, exited their vehicle and brandished
firearms. One of the men, identified as 28-year-old Carlos McLean, held the second victim at gunpoint and demanded money. In the midst of the robbery, Vargas-Matilde engaged in a struggle with one of McLean's accomplices. As he attempted to flee the scene, he was shot in the back. Authorities were called, and Johnathan Vargas-Matilde was pronounced dead at the scene at 3:59 a.m.
The investigation into the homicide led to the arrest of Carlos McLean, who was charged with felony murder and robbery. During his trial, the prosecution maintained that McLean was responsible for the shooting that led to Vargas-Matilde's death. McLean admitted to being present during the robbery but claimed that one of his co-conspirators was the one who fired the fatal shot.
Despite his defense, an Essex County jury found Carlos McLean guilty of the felony murder of Johnathan Vargas-Matilde and the robbery of the second victim. He was, however, acquitted of the robbery of Vargas-Matilde and the direct murder charge. Following his conviction, McLean faced the possibility of a life sentence in prison.
