On a late Wednesday night, September 2, 2015, the sound of gunfire shattered the peace outside the Fitzsimons Apartments at 1568 Nome Street in Aurora, Colorado. When the chaos subsided, 14-year-old Marcell Jay Johnson, a Black male, was found with a fatal gunshot wound to the chest. Another teenager, a 17-year-old boy, was also struck by a bullet in the arm but survived his injuries.
The incident cut short the life of young Marcell, who had just embarked on his first week of high school.
The following morning, law enforcement authorities apprehended 18-year-old James Jason Tobias Lee in connection with the shooting. Initially, Lee faced a first-degree murder charge, which carried a potential mandatory sentence of life in prison without parole. He was also charged with attempted murder and second-degree assault for the injury to the second victim. Neighbors and a gang rescue advocate speculated that the shooting might have been gang-related, though it remained unclear if Johnson was the intended target or mistakenly identified. In the wake of the tragedy, over 200 friends and family members gathered for a vigil to mourn the profound loss of a young life full of potential.
On July 29, 2016, the legal proceedings against James Jason Tobias Lee concluded. He was ultimately convicted of reckless manslaughter, two counts of attempted reckless manslaughter, and third-degree assault. Despite the district attorney's office arguing for a sentence in the 'aggravated' range due to his criminal history, Lee was sentenced to ten years in prison for his role in Marcell Jay Johnson's death.
