In the late hours of a September evening in Colorado Springs, a domestic turmoil reached a tragic and fatal conclusion for Martin Rodriguez Ramirez, a 34-year-old man. On September 4, 2020, officers were called to a residence in the 4500 block of London Lane around 10:00 P.M. following a report of a shooting. Upon their arrival, they discovered Mr. Rodriguez Ramirez deceased with a gunshot wound.
His death was later classified as the 25th homicide in the city that year.
The events leading to the fatal shooting began when Mr. Rodriguez Ramirez arrived home intoxicated and started an argument with his 21-year-old stepson, Isacc Montoya. Despite Isacc's attempts to retreat and avoid a physical confrontation, Mr. Rodriguez Ramirez pursued and assaulted him. According to witnesses, he held Isacc by the head or shoulders and repeatedly slammed his head against the pavement.
The altercation took a deadly turn when Mr. Rodriguez Ramirez's other stepson, 18-year-old Xavier Montoya, witnessed the assault on his brother. In an act to protect his family member from what was deemed to be the threat of serious bodily injury or death, Xavier Montoya discharged a firearm once, striking his stepfather in the head.
Following an investigation into the shooting, the case was reviewed by the 4th Judicial District Attorney's Office. On March 10, 2021, it was announced that no criminal charges would be filed against Xavier Montoya. The District Attorney's Office concluded that Xavier's actions were justified under the principle of defense of others. Factors that influenced this decision included Mr. Rodriguez Ramirez's aggression, the continuous nature of his assault on Isacc Montoya, and the lack of other means for Xavier to resolve the violent incident.
