The investigation identified John Joseph "JJ" Gutierrez, a 25-year-old man from Hitchcock, Texas, as the primary suspect. Witnesses reported seeing Gutierrez fleeing the scene with a tan-colored Glock pistol immediately after the shooting. Further inquiry revealed that Potier had been attempting to court one of the women involved in the altercation, who was in a romantic relationship with Gutierrez. This connection is believed to have motivated the shooting.
Gutierrez was arrested on November 14, 2023, at his residence in Hitchcock by Jefferson County Sheriff's Office deputies. He was charged with first-degree murder and held on a $1 million bond. Subsequent investigations uncovered attempts by Gutierrez and his associates to obstruct justice by providing false statements and concealing evidence, including the disposal of the firearm used in the crime.
