On April 8, 2024, 25-year-old Jose Cruz Jr. was fatally shot in Mission, Texas, during a road rage incident. According to an affidavit, Peña admitted to shooting at Cruz's vehicle multiple times during a road rage incident, claiming self-defense. After the shooting, Peña fled to Díaz Ordaz, Tamaulipas, Mexico, but later turned himself in at the Rio Grande City port of entry. He was subsequently transported to the Mission Police Department and cooperated with investigators, leading to the recovery of a 9mm Glock handgun believed to be the murder weapon.
Peña's bond was initially set at $2 million but was later reduced to $750,000, prompting outrage from Cruz's family and community members. They expressed concerns over the bond reductions, especially given Peña's previous flight risk and history of violence.
