In the summer of 2023, the life of 16-year-old Demarion Mikel Black was tragically cut short in Owensboro, Kentucky. A student at Heritage Park High School, Demarion was known for his infectious sense of humor and his loyalty to his family and friends. He had a passion for playing football and basketball and was a budding rap artist. Those who knew him described him as having a heart of gold, leaving a positive impact on everyone he encountered.
On the evening of June 24, 2023, in the
1800 block of Hughes Avenue, tragedy struck. At approximately 9:11 p.m., officers from the Owensboro Police Department responded to a call and found Demarion with multiple gunshot wounds. He was quickly transported to Owensboro Health Regional Hospital, but succumbed to his injuries and was pronounced dead.
The investigation into the death of Demarion Black quickly led to a suspect, another 16-year-old male named Peiyton A. Smith. Smith was taken into custody and initially charged with murder, possession of a handgun by a minor, and trafficking in marijuana. Due to his age, his identity was not immediately released to the public. The case was eventually transferred from the juvenile court system to the adult circuit court.
In May 2024, Peiyton Smith, then 17, accepted a plea agreement, avoiding a murder trial. He pleaded guilty to second-degree manslaughter, trafficking in marijuana, and possession of a handgun by a minor. The terms of the plea deal included a recommended sentence of 10 years in prison for the manslaughter charge, to be served concurrently with sentences for the other charges. During the sentencing hearing, family members of both Demarion and Peiyton spoke about the profound impact of the incident. Demarion's mother expressed her belief that a 10-year sentence was not enough for the loss of her son's life. In July 2024, a judge formally sentenced Smith to 10 years in prison, in accordance with the plea agreement.
