On May 30, 2023, a fatal shooting occurred in North Miami Beach, Florida, resulting in the death of 21-year-old Malcolm Avery Johnson Jr. The incident happened around 1 a.m. in the area of Northwest 170th Street and Northwest 3rd Avenue.
Surveillance video captured the events leading to Johnson's death. The video shows Johnson walking north on Northwest 3rd Avenue when a black Nissan Maxima, which had been reported stolen on May 17, slowly passed him. The car suddenly stopped, and 20-year-old Marcuss Ealy, who was in the front passenger seat, got out and approached Johnson while pointing a pistol rifle at him. Ealy grabbed a chain from Johnson's neck, and 22-year-old Mario Fogler, who was also in the car, got out and went through Johnson's pockets, taking items that fell onto the street.
During the struggle, Ealy walked up to Johnson and fired four rounds at close range, resulting in gunshot wounds to Johnson's head and chest. Both suspects then returned to the car and fled the scene. Johnson was found dead at the scene, with a broken metal chain near his body.
The investigation led to the identification of the suspects through a license plate reader in Miami Gardens and a facial recognition app. The woman who had rented the car provided a photo of one of the men involved, which helped identify Fogler. Both Marcuss Ealy and Mario Fogler were arrested and face first-degree murder charges in connection with Johnson's killing. Ealy was transferred to a Miami jail after being arrested in Broward County in June 2023 and is being held without bond at the Turner Guilford Knight Correctional Center.
