Benjamin Andrew Bullington, a 28-year-old White man, died after being shot in White Sulphur Springs, Montana, in the early morning of May 21, 2023. Responding to a report of gunshots, deputies from the Meagher County Sheriff's Office arrived at a residence at 206 East Baker Street. Inside, they found Bullington with a gunshot wound to his chest. He was rushed to Mountainview Medical Center, where he was pronounced deceased.
The investigation was handled by the Meagher County Sheriff’s Office with assistance from the Montana Division of Criminal Investigation, the Montana Crime Laboratory, and the Montana Highway Patrol. At the scene, investigators found another man, Dominic Paul Driscoll, a 31-year-old from Clancy, who had sustained a gunshot wound to his ankle.
After receiving medical treatment for his injury, Driscoll was arrested and charged with deliberate homicide in Bullington's death. He was transported to the Broadwater Detention Center to await trial.
Authorities stated that they were not seeking any other suspects in the case.
Driscoll’s case went to a four-day trial in Meagher County. His defense team argued that he had acted in self-defense, claiming that Bullington had been the aggressor during the fatal encounter. On January 30, 2024, after deliberating for about four hours, the jury returned a verdict.
The jury found Dominic Paul Driscoll not guilty of deliberate homicide. He was acquitted of the charge and released from custody. As of January 2024, no one has been convicted in the death of Benjamin Bullington, and the case remains unsolved.
