On September 30, 2023, at approximately 4:12 p.m., 29-year-old Thomas George "Tommy" Bostany was found unresponsive inside his vehicle in the parking lot of the Mountainside Villas Apartments, located in the 1000 block of Penthouse Drive in Birmingham, Alabama. Responding officers from the South Precinct discovered that Bostany had been shot; he was pronounced dead at the scene by Birmingham Fire and Rescue personnel.
