On the night of December 23, 2023, a brutal attack in Birmingham, Alabama’s Spring Lake neighborhood claimed the life of David Nicholas, a 43-year-old Caucasian man. Just before midnight, police responded to a report of a person shot in the 1400 block of Lake Lane Northeast. Officers arrived to find Mr. Nicholas outside a home, suffering from severe injuries. According to court documents, he had been stripped, bound, and tortured inside a residence before being shot. Birmingham Fire and Rescue Service personnel pronounced him dead at the scene.

The violence that night also targeted Mr. Nicholas’s girlfriend. Sources state that she was beaten, stripped, and forced to watch as he was killed. The assailants then kidnapped her from the home. The woman was later found safe by police inside a vehicle in the parking lot of a Walmart Supercenter in Leeds.

The investigation quickly led authorities to three individuals. At the same Walmart where the kidnapped woman was rescued, police arrested 33-year-old Joshua Corey Guthrie of Fairfield. Investigators also identified two other suspects: Dustin Harry Stanfield, 43, of Hoover, and Brittany Patterson, 34, of northern Jefferson County.

On July 19, 2024, a Jefferson County grand jury returned indictments against Guthrie, Stanfield, and Patterson, formally charging all three with capital murder and kidnapping. Following the indictment, Joshua Corey Guthrie was tried before a Jefferson County jury. He was convicted of felony murder in the death of David Nicholas and has been sentenced for the crime.
