On August 13, 1989, Theophilus Kermit Fleming Sr., aged 79, was found murdered in his apartment on North Hartford Avenue in Tulsa, Oklahoma. He was discovered by his son, Theophilus Jr., who had arrived around 9:30 a.m. to pick him up for a visit. Upon arrival, Theophilus Jr. found the front door kicked in, and his father lying dead inside. Theophilus Sr. had been strangled and suffered blunt force trauma to the head.
