He was held at the Robeson County Detention Center without bond. The North Carolina State Bureau of Investigations assisted with the case.
McMillan's criminal history included a previous conviction in 2008 for possession of a Schedule II substance in Robeson County. Additionally, he faced charges of robbery with a dangerous weapon and felony larceny, although these charges were not related to Smith's murder.
