David Cardiel, a 37-year-old Latino, was tragically shot and killed on March 21, 2015, near Eastlake Avenue and George Street in Lincoln Heights, Los Angeles. According to the Los Angeles County coroner's records, the incident occurred shortly before 7 p.m. when Cardiel, driving a white SUV, stopped to talk to a man. During this interaction, the man pulled out a gun and shot Cardiel, causing him to crash into at least one parked car.
Cardiel sustained multiple gunshot wounds to his face and body and was pronounced dead at the scene at 7:11 p.m.
The investigation into Cardiel's death led detectives to Hector Castillo, a 28-year-old Latino. Castillo was arrested on suspicion of murder on August 14, 2015. He was subsequently charged with one count of murder and one count of shooting at an occupied vehicle. Castillo pleaded not guilty to the charges and was due back in court on October 15, 2015. The case against Castillo included physical evidence collected at the scene, which played a crucial role in identifying him as the suspect.
In the legal proceedings that followed, Hector Castillo was convicted of first-degree murder, shooting at an occupied motor vehicle, and two counts of unlawful possession of a firearm. The jury found true the gang enhancement allegations related to all four offenses, as well as firearm enhancement allegations pertaining to the murder and shooting at an occupied motor vehicle convictions. Castillo was sentenced to an aggregate prison term of 50 years to life, with a minimum parole eligibility date of 15 calendar years. Additionally, the court imposed, but stayed, certain prison terms, including two 10-year gang enhancements.
Throughout the trial, Castillo's defense raised several claims, including prosecutorial misconduct, erroneous exclusion of evidence supporting his theories of imperfect self-defense and third-party culpability, instructional error, and insufficiency of the evidence supporting the gang allegations. However, these claims were ultimately rejected by the court, and Castillo's conviction was upheld on appeal.
