In the waning hours of a September evening in north Baltimore, a dispute erupted that would tragically claim the life of 27-year-old Kenneth Bivens. On September 10, 2020, in the 1000 block of Beaumont Street, Bivens was involved in an argument with another man that escalated with fatal consequences. A single gunshot to the head left him critically injured.
Emergency responders transported Bivens to a local hospital, but his injuries proved insurmountable, and he succumbed two days later on September 12, 2020.
The investigation into the shooting led Baltimore police to identify Donnell Johnson, then 28 years old, as the suspect. He was taken into custody on September 17, 2020, by the Warrant Apprehension Task Force and U.S. Marshals and subsequently charged with first-degree murder. Homicide detectives pieced together the events of that evening, suggesting that the deadly encounter occurred during a marijuana transaction. Investigators found that the last call made from Bivens' phone was to a number linked to Johnson. When questioned, Johnson denied being at the scene and denied knowing Bivens had been shot.
Donnell Johnson's legal journey was a protracted one, involving multiple trials. His first two trials, held in 2021 and 2024, both concluded in mistrials after juries were unable to reach a unanimous verdict. The defense in one of the trials highlighted a lack of physical evidence, such as DNA or fingerprints, connecting Johnson to the crime scene. A third trial commenced in October 2025. After hearing testimony and reviewing the evidence, which included recorded witness statements, a jury acquitted Donnell Johnson of the murder of Kenneth Bivens on October 31, 2025.
