In the late summer of 2015, the life of 26-year-old Justin Wayne Kirby, a Caucasian male, was tragically cut short in Bloomington, Indiana. On September 26th, Justin, a stay-at-home father of three who was known for his love of the outdoors, was shot and killed by his wife, Taylor Kirby, in their home on San Juan Drive. The incident occurred during what was described as an argument between the couple. Taylor Kirby would later claim that she acted in self-defense, fearing for her life.
According to Taylor's account of the events, she retrieved a. 380 Ruger handgun from a bedroom, loaded it, and concealed it in her pocket. She stated that when she came out of the bedroom, Justin approached her, and it was at this moment she fired the weapon four times. However, the investigation by the Monroe County Sheriff's Office uncovered evidence that cast doubt on her claim of self-defense. The placement of the bullet wounds, including one in Justin's back, suggested that he was attempting to flee when he was shot. This finding was a significant factor for prosecutors, who were suspicious of Taylor's version of the events.
Initially, Taylor Kirby was charged with murder for the death of her husband. As the legal process unfolded, the charge was later amended to voluntary manslaughter. This change reflected the belief that the killing happened in a sudden heat of passion rather than being a premeditated act. Ultimately, Taylor Kirby pleaded guilty to voluntary manslaughter.
In December 2016, a judge sentenced Taylor Kirby to 22 years in prison. The sentence was composed of 17 years for voluntary manslaughter with an additional five years for the use of a firearm in the commission of the crime. During the sentencing, Justin Kirby's adoptive parents expressed their dissatisfaction with the plea agreement, believing that the sentence was not long enough for the loss of their son's life. In a brief statement to the court, Taylor Kirby expressed remorse for her children losing their father and stated she had asked God for forgiveness.
