On November 4, 2015, authorities in Indianapolis, Indiana, initiated a homicide investigation following the discovery of a mortally wounded man in the downtown area. The victim, identified as 62-year-old Black male Tito McCombs, had suffered a gunshot wound and was transported to a local hospital where he subsequently succumbed to his injuries. McCombs, who had roots in Lansing, Michigan, became the focus of an inquiry led by the Indianapolis Metropolitan Police Department as detectives sought
to piece together the events leading to his violent death during a turbulent night in the city.
Detective Daniel Kepler spearheaded the investigation, which soon uncovered leads pointing toward a suspect named Davin Hollingsworth. As part of the probe, investigators interviewed a witness, Jasmine Wills, who provided critical testimony. Wills informed detectives that Hollingsworth had admitted to her that he was responsible for shooting McCombs. Further complicating the case, allegations arose that following the shooting, the perpetrator had stolen McCombs's vehicle and driven it away from the scene before intentionally setting it on fire in an attempt to destroy evidence.
Based on the gathered evidence, prosecutors charged Hollingsworth with murder and arson in connection with McCombs's death and the destruction of his property. The legal proceedings that followed painted a complex picture of the incident, with the prosecution relying heavily on witness statements regarding Hollingsworth’s alleged admissions.
The case eventually went to trial, resulting in a split verdict that highlighted the evidentiary challenges faced by the state. While the jury found Hollingsworth guilty of arson for the burning of the victim's car, he was acquitted of the murder charge, meaning he was not legally held responsible for the killing of Tito McCombs itself. Following the criminal trial, the legal battles continued in federal court, where Hollingsworth filed a civil rights lawsuit against Detective Kepler, challenging the conduct of the investigation that had linked him to the homicide.
