In the quiet suburbs of Williamsburg, Virginia, the life of 32-year-old Giancarlo di Fazio was abruptly ended in a violent encounter within his own home on Burgundy Road. On the afternoon of September 25, 2016, his wife, Lynn Fogarty, also 32 at the time, placed a call to the York-Poquoson Sheriff's Office, stating she had shot her husband. When deputies arrived, they found Giancarlo di Fazio deceased inside the residence from a gunshot wound.
Investigators believe the shooting occurred as he was about to use the bathroom.
Lynn Fogarty was taken into custody that same day and was initially charged with second-degree murder and the use of a firearm in the commission of a felony. In her call to authorities and subsequent statements, Fogarty claimed she was a victim of domestic violence, though investigators noted she showed no signs of physical abuse after the shooting. Court documents later revealed that she was intoxicated on the day of the incident. The investigation also delved into the couple's finances, with search warrants being filed to examine Giancarlo di Fazio's life insurance policies after his father raised concerns that the beneficiary may have been changed shortly before his death.
As the case progressed through the legal system, the charges against Lynn Fogarty were elevated. In May 2017, a grand jury indicted her on a charge of first-degree murder, suggesting a 'willful, deliberate, and premeditated' act. However, in January 2020, Fogarty chose to plead guilty to the lesser charge of voluntary manslaughter. A few months later, she was sentenced to 10 years in prison, with six years and six months of that sentence suspended, resulting in an active prison term of three and a half years.
