In the late hours of a Wednesday evening in Asbury Park, New Jersey, the life of a young boy was tragically cut short. On February 21, 2018, 10-year-old Yovanni Daniel Banos-Merino was inside his home on Ridge Avenue when gunfire erupted. The boy and his mother, Lilia Merino, were both struck by the bullets that pierced their first-floor apartment. Both were rushed to Jersey Shore University Medical Center, where Yovanni was pronounced dead. His mother was treated for her injuries and survived the horrific ordeal.
The investigation quickly revealed that neither Yovanni, a student at Bradley Elementary School, nor his mother were the intended targets of the shooting. Investigators determined that the gunfire was the result of a dispute involving another person inside the residence at the time. The Monmouth County Prosecutor's Office launched a thorough investigation, seeking to bring those responsible for the senseless act of violence to justice.
The community was left in shock and mourning for the young boy who was remembered for his love of playing football, soccer, and riding his skateboard with friends.
Within days, the investigation led to the identification and arrest of two suspects. A 16-year-old from Neptune Township, Jah-Del K. Birch, was taken into custody at his high school the day after the shooting. The alleged shooter, 18-year-old Karon Council, also from Neptune, fled the state. He was tracked to Pompano Beach, Florida, where he was apprehended by U.S. Marshals.
Both Council and Birch faced serious charges, including murder and conspiracy to commit murder. In October 2018, both young men pleaded guilty to first-degree aggravated manslaughter and second-degree possession of a weapon for an unlawful purpose. The plea agreements were reached after consultation with Yovanni's mother. Under the terms of his plea deal, the prosecution recommended a 25-year prison sentence for Council, while a 10-year sentence was recommended for Birch. Both sentences would require them to serve 85 percent of their time before being eligible for parole.
