Kimberly Ann Mollicone, a 49-year-old female, died on July 12, 2022, in a violent shootout that erupted from a love triangle. On that evening, Kimberly and her husband, Matthew Louis Mollicone, drove to the Ray Township, Michigan, home of Daniele Giannone, a man with whom Kimberly had been having a years-long affair. Matthew Mollicone went to the residence to confront Giannone and demand he cease contact with his wife.
The situation quickly escalated from a verbal argument into a gunfight.
The confrontation began as Giannone was outside cooking on a grill. When Matthew Mollicone reached for a firearm in his waistband, Giannone fired a warning shot. A shootout between the two men ensued, during which Giannone was shot in the leg. As Giannone retreated into his home to get another weapon, the Mollicones started to back their vehicle out of the driveway. More shots were exchanged, and Kimberly Ann Mollicone was struck in the neck by a bullet and died at the scene. The entire incident lasted less than two minutes, with over 30 shell casings from three different guns recovered by investigators. Several of Giannone's family members, including children, were inside the home at the time of the shooting.
Matthew Mollicone was arrested at the scene. He was later charged with multiple felonies, including felony murder and assault with intent to murder. The other man involved in the shooting was initially taken into custody but was released without being charged. During the trial, prosecutors argued that Matthew Mollicone was responsible for his wife's death because he brought her into a dangerous situation. Mollicone's defense attorneys contended that Giannone should have been charged with murder, as he fired the fatal shot.
In May 2024, a jury found Matthew Louis Mollicone guilty of voluntary manslaughter, assault with intent to murder, and three counts of felony firearm. In July 2024, he was sentenced to serve 86 months to 15 years for voluntary manslaughter and 12 to 40 years for assault with intent to murder, in addition to a consecutive two-year sentence for the felony firearm charges.
