In the small community of Four Mile, just outside of Pineville, Kentucky, a dedicated officer of the law, Deputy Sheriff Tom Stewart of the Bell County Sheriff's Department, met a violent and untimely end. His death stemmed from his commitment to upholding the law, even when faced with direct threats to his own life. The man responsible for his death was Jackson 'Bad Jack' Asher, a man with whom Deputy Stewart had previous dealings.
The history between the two men was fraught with
conflict. Asher had been previously arrested by Stewart and harbored a deep-seated resentment. He had gone so far as to explicitly threaten the deputy, warning him that another attempt to arrest him would result in Stewart's death. Undeterred by this ominous warning, Deputy Stewart proceeded with his duty when the time came to once again bring Asher into custody.
On that fateful day, the confrontation escalated quickly. In a tense standoff, Asher first fired a warning shot into the ground, a clear and final ultimatum. When Deputy Stewart pressed on with the arrest, Asher made good on his threat and fired a fatal shot at the lawman. In the immediate aftermath, Asher fled the scene, becoming a fugitive from justice. His freedom, however, was short-lived, as he was apprehended by law enforcement several days later, bringing an end to the immediate manhunt.
The legal proceedings that followed were complex. Prior to killing Stewart, Asher had a history with the justice system, having been convicted of murder in 1901 and sentenced to life, only to be acquitted after a new trial. For the killing of Deputy Stewart, Asher was ultimately convicted of manslaughter and sentenced to 10 years in prison. He was paroled but soon violated the terms of his release and was returned to prison. After his subsequent release, he formed a criminal gang. His life of crime culminated in another shootout with deputies, including Deputy Stewart's own brother, which led to another man's death and a deputy's injury. Asher was eventually captured again and sentenced to life in prison for murder.
