In the late morning of August 23, 2004, a violent encounter in a Brockton, Massachusetts backyard cut short the life of 30-year-old John Falcone. The male victim was discovered in the rear of a property at 24 Farrington Street, the victim of a fatal shooting.
The investigation into the homicide eventually pointed to Lewis Franklin, a man described as being significantly taller than the victim.
Witnesses recounted hearing two men arguing behind the residence shortly before the sound of gunfire. One young witness, who was fourteen at the time and lived next door, heard the argument from his bedroom window.
The case against Franklin was built on witness testimony and other evidence gathered by the Brockton police. Testimony revealed that on the morning of the murder, Franklin had arranged to meet with individuals, including Falcone, for a drug transaction. A dispute is believed to have erupted during this meeting, escalating to the fatal shooting.
Following the investigation, Lewis Franklin, an African-American male, was arrested and charged with the murder of John Falcone. He was subsequently convicted of murder in the first degree on a theory of deliberate premeditation. The trial featured testimony from several individuals who were present in the vicinity of the crime scene, as well as those who interacted with Franklin before and after the killing. The conviction was later upheld by the Massachusetts Supreme Judicial Court, solidifying the legal conclusion to the tragic death of John Falcone.
