In the turbulent summer of 2020, amidst nationwide protests, the life of Jake Gardner, a 38-year-old White male and former Marine, took a drastic and ultimately tragic turn. On the night of May 30, in downtown Omaha, Nebraska, Gardner, the owner of The Hive bar, became embroiled in an altercation with protesters. The confrontation escalated, culminating in Gardner fatally shooting a 22-year-old Black man named James Scurlock.
Initially, the county attorney deemed the shooting an act of self-defense and declined to press charges against Gardner. This decision, however, was met with public outcry and further fueled the ongoing protests in the city.
The initial finding of self-defense did not close the case. Following intense public pressure, a grand jury was convened to review the incident. After examining additional evidence, which included text messages and social media posts from Gardner, the grand jury returned an indictment. Gardner was charged with several felonies, including manslaughter, use of a firearm to commit a felony, attempted first-degree assault, and making terroristic threats. The special prosecutor assigned to the case stated that evidence, some of it from Gardner himself, undermined the claim of self-defense and suggested an intentional killing.
Faced with the prospect of a lengthy prison sentence, Gardner relocated to the West Coast. On September 20, 2020, the day he was scheduled to return to Omaha to turn himself in to authorities, his body was found outside a medical clinic in Hillsboro, Oregon. His death was determined to be a suicide. According to his attorneys, the indictment had come as a shock to Gardner, who had also been dealing with traumatic brain injuries from his military service and had been the target of death threats. No suspects were sought in connection with his death, and authorities stated there was no danger to the community.
