Derek Driskill was a 39-year-old Black man from the Cleveland, Ohio, area, remembered by loved ones as a husband, brother, and best friend. His life was cut short following a minor traffic incident that escalated into deadly violence.
On the evening of September 23, 2023, Driskill was in the parking lot of a carryout near 124th and Union Street on Cleveland's east side when another car struck the back of his new Mercedes Benz.
According to investigators, the driver of the other vehicle was cooperative, but a passenger got out and began arguing with Driskill. The confrontation escalated, and the passenger shot Driskill in the head before fleeing the scene. Driskill’s wife, Andrea Johnson, later recalled her initial hope that he would survive, but he died from his injuries two days later on September 25, 2023.
The alleged shooter was identified as 22-year-old Amarion Sanders. He later turned himself in to authorities and was charged with aggravated murder. Johnson said that Sanders did not know her husband and that the shooting was "so unnecessary." Sanders was held in the Cuyahoga County jail on a $1 million bond.
Months later, the case took an alarming turn when Sanders was mistakenly released from jail. Officials stated that a "typographical error" made by the court led to the accidental dismissal of Sanders' case instead of a different case with a similar number. The Cuyahoga County Prosecutor's Office confirmed that it had not filed a motion to dismiss and immediately notified the court of the error the following morning.
The mistaken release left Driskill's family feeling unsafe and distraught. "That's not justice," Johnson said. "I mean, he's out on the street and can do it to somebody else." She questioned how a suspect allegedly captured on video committing a crime could be freed by mistake.
The court filed a motion to correct its clerical error and reissued a warrant for Sanders' arrest. U.S. Marshals located and recaptured him on Cleveland’s West Side. As of his rearrest, Amarion Sanders was returned to custody and is awaiting trial for the murder of Derek Driskill.
