For 13-year-old Amber Renee Archuleta, it was a time of listening to music with friends before the start of the new school year. On the afternoon of July 28th, she was at a friend's home with three other juveniles. What began as a relaxed gathering of teenagers took a tragic and unexpected turn. Inside the home, a 14-year-old boy, Porfirio Brown, obtained his father's gun.
A single shot was fired, and Amber was fatally wounded.
The immediate aftermath was one of panic and a misguided attempt to conceal the truth. Instead of immediately calling for help, the teenagers initially concocted a story of a drive-by shooting. Amber's body was moved outside, and then a call was placed to 911. When the Questa Police Department arrived, they found her on the ground next to the back porch of the Brown family's property. Despite efforts to save her, Amber succumbed to her injuries on July 29, 2023.
The investigation that followed unraveled the initial story. The 14-year-old boy who fired the shot was arrested and faced serious charges, including first-degree murder and tampering with evidence. His father, William Brown, was also arrested and charged under a new New Mexico law, making it a felony to negligently make a firearm accessible to a minor resulting in death. This was reportedly the first time this charge had been applied in the state. Amber was remembered as a talented artist whose work was displayed at the local library. She had taught herself to play the guitar and was a devoted fan of the Denver Broncos. Friends and family described her as having a spunky, playful, and supportive nature. A public memorial was held at the Questa High School gymnasium to celebrate her life. In a subsequent turn of events, the second-degree murder charge against Porfirio Brown was dismissed in August 2024, with his defense attorney arguing there were significant procedural errors in the investigation, including a failure to properly secure the crime scene.
